1. About these terms

These terms of use set out the rules for using the website and the Virtuosa AI platform (together, the "Site") operated by Monolith Building Pty Ltd ACN 156 630 143 ("Monolith", "we", "us" or "our").

By accessing or using the Site you agree to be bound by these terms. If you do not agree, please do not use the Site.

2. Changes to these terms

We may update these terms from time to time. The version published on this page applies from the moment it is published. If you keep using the Site after a change, you accept the updated terms.

3. Accounts and access

Parts of the Site require an account. You must provide accurate information when registering, keep your login credentials confidential, and tell us promptly if you believe your account has been accessed without authority.

Accounts are for use by registered practitioners and their authorised practice staff. You are responsible for activity that occurs under your account.

4. Acceptable use

You must not use the Site in a way that breaks the law, infringes anyone's rights, or interferes with the operation or security of the Site. You must not attempt to gain unauthorised access to any part of the Site, other accounts, or the systems that support it.

You must only upload material you are entitled to upload, and only where doing so is consistent with your professional and privacy obligations to your clients.

5. Clinical responsibility

Virtuosa AI produces draft clinical documents to support, not replace, professional judgement. Every draft must be reviewed, corrected where necessary, and approved by a qualified practitioner before it is relied on or provided to anyone.

The Site does not provide medical, psychological or legal advice, and nothing generated by it is a diagnosis or a clinical decision. Responsibility for clinical decisions and final documents rests with the treating practitioner.

6. Privacy and data

We handle personal information in accordance with Australian privacy law. Client material uploaded to the platform is stored, and AI processing is performed, in Australia.

Our privacy practices are described in our Privacy Policy, which forms part of these terms.

7. Intellectual property

The Site, including its software, design, text and branding, is owned by or licensed to Monolith and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from any part of the Site except as these terms allow or the law permits.

You retain your rights in the material you upload and the reports you finalise. You grant us the limited licence needed to operate the Site for you, and nothing more; we do not use your client material to train AI models.

8. Third-party links and services

The Site may link to third-party websites or rely on third-party services. We do not control them and are not responsible for their content or practices.

9. Availability and disclaimers

We work to keep the Site available and accurate, but we do not promise it will be uninterrupted, error-free or free of harmful components, and we may change, suspend or withdraw features at any time.

Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, the Site is provided "as is" and we exclude all other warranties, whether express or implied.

10. Liability

To the extent permitted by law, and subject to the consumer guarantees referred to above, we are not liable for indirect or consequential loss arising from your use of the Site, and our total liability in connection with the Site is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

11. Suspension and termination

We may suspend or terminate access to the Site where these terms are breached, where the law requires it, or where it is reasonably necessary to protect the Site or its users. You may stop using the Site, and may close your account, at any time.

12. Governing law

These terms are governed by the laws of Western Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
